Terms of Use

1. Agreement

These Terms of Use (“Terms”) govern your use of the Service, operated by [PLACEHOLDER — Ballust legal entity name and registered address] (“Ballust”, “we”, “us”). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

2. Eligibility and accounts

• You must be at least 16 years old, or the age of digital consent in your jurisdiction, to use the Service.
• The athlete app uses Sign in with Apple; coach accounts use email sign-in links. You are responsible for keeping access to those credentials secure and for activity under your account.
• You can delete your account at any time in the app’s settings. Deletion removes your plans, sessions, feedback, and connected-provider records as described in the Privacy Policy.

3. Your content and data

Your training data, notes, and feedback remain yours. You grant Ballust a limited licence to store and process that content solely to operate the Service — including sharing what you choose with the coach you are connected to. You can revoke that sharing by disconnecting at any time. Health data read from Apple HealthKit is processed on your device and is not sent to us, as described in the Privacy Policy.

4. Acceptable use

Do not use the Service to:

• violate any law or the rights of anyone else;
• harass, threaten, or abuse other users, including coaches and athletes you are connected with;
• interfere with or overload the Service, or attempt to gain unauthorised access to it, other accounts, or our systems;
• upload content you do not have the right to share, or reverse-engineer the apps except as permitted by law.

Coaches are independent professionals. Ballust provides tooling and is not a party to the coaching relationship, advice given in it, or any arrangement between a coach and an athlete.

5. No medical advice

The Service provides training planning and tracking tools. It is not a medical device and does not provide medical advice, diagnosis, or treatment. Always seek the advice of a qualified health professional with any questions about a medical condition or before beginning, changing, or stopping any training or exercise program. Do not rely on readiness, load, or completion metrics as a substitute for professional judgment.

6. Availability, changes, and termination

• We aim for reliability but do not guarantee uninterrupted availability. We may modify or discontinue features; if a change materially reduces what the Service does, we will tell you in the app.
• The current version of the Service has no paid subscriptions or in-app purchases. If paid plans are introduced, their terms will be presented before you purchase.
• You may stop using the Service and delete your account at any time. We may suspend or terminate accounts that violate these Terms or the law, with notice where practical.

7. Third-party connections

Optional connections such as Strava (and Garmin Connect when available) are provided by those providers under their own terms. Disconnecting a provider in Ballust revokes our access, and you should also review your authorisations in that provider’s own settings.

8. Disclaimers and limitation of liability

The Service is provided “as is” and “as available” without warranties of any kind, to the fullest extent permitted by law. To the maximum extent permitted by law, Ballust is not liable for indirect, incidental, or consequential damages, or for loss of data, profits, or training outcomes, arising from your use of the Service. Nothing in these Terms limits liability that cannot be limited by law, including for death or personal injury caused by negligence, or for fraud.

9. General

• These Terms are governed by the laws of the State of Western Australia, Australia, without regard to conflict-of-laws rules.
• If any provision is unenforceable, the rest remains in force.
• We may update these Terms; material changes will be surfaced in the app, and the “Last updated” date above will change. Continued use after a change means you accept the updated Terms.
